The International Criminal Court prosecutor seeks to question staff who served in the Waki Commission in fresh investigations launched on the Kenyan cases.
The Office of the Prosecutor (OTP) now headed by Ms Fatou Bensouda has written to the government asking for permission to question staff who worked with the Commission of Inquiry into Post-election Violence chaired by Mr Justice Philip Waki.
Attorney-General Githu Muigai confirmed that his office and that of the Chief Justice had authorised officials who served in the Waki Commission to talk to the ICC officials.
“We have allowed officers who supported the commission to help the ICC officials as per the request,” Prof Muigai said on Thursday. It was not clear whether the court officials would also interrogate Justice Waki.
Deputy Prime Minister Uhuru Kenyatta, former head of Public Service Francis Muthaura, Eldoret North MP William Ruto and radio presenter Joshua arap Sang are facing crimes against humanity charges at the court.
On Thursday, the OTP public information officer, Ms Florence Olara, told the Nation that advanced investigations in preparation for trials were currently ongoing.
“The Office of the Prosecutor will not comment on the scope or details of current on-going investigations. However, I can confirm that our investigation in Kenya remains on going in advance of the start of trial,” said Ms Olara.
Investigations further revealed that the court intended to inquire the roles of certain security chiefs including members of the Provincial Administration who served in post-election violence hot spots.

But on Thursday police spokesman Eric Kiraithe denied knowledge of any investigations targeting police commanders.
“I am not aware of any such investigations. I have not heard of it,” Mr Kiraithe said.
Former Rift Valley PC Noor Hassan said he had been contacted for any help by the ICC over post-election violence.
