Pending case Turk to deposit Sh2m

A Turk with a pending a court case, and who was arrested at Jomo Kenyatta International Airport (JKIA) as he was about to leave the country, has been ordered to provide Sh2 million as security.
Mr Justice John Mwera of the High Court in Mombasa ordered Mr Rasim Selcuk to deposit the money in the joint account of advocates Balala Abed and Nabhan Swaleh, within one week before he was allowed to leave the country.
He was also directed to surrender his passport with his lawyer, Mr Mohammed Balala, who will hold it until he has deposited the security. Thereafter he will be at liberty to travel out of the country.
Mr Selcuk was brought to court yesterday after immigration officials at JKIA arrested him for undisclosed reasons and detained him at the airport.
The court had earlier declined to stop the foreigner from leaving the country and instead ordered that he deposits Sh2,037,168 (US$24,252) as security pending the hearing and determination of a case filed by Mr Osman Elsek, a Mombasa contractor.
However, Mr Selcuk was arrested and detained at JKIA’s immigration office, where the officers were acting pursuant to the order, until Thursday afternoon when the court ordered that he be produced in court.
Lawyer Balala told the court that he was shocked to find that there was no order of arrest, contrary to the allegations by the immigration.
“This is the Artur saga all over again where foreigners are controlling the immigration on who to arrest or not to arrest,” he said, adding that the officers denied Mr Selcuk access to lawyers and Turkish embassy officials who had gone to protest against the arrest of their citizen.
Justice Mwera ordered the immigration officials to allow Mr Selcuk to remain in the country for two weeks so that he can deposit the money.
The case will be heard on July 14.
