Poll chaos victims to bolster ICC case

More than 300 post-election violence victims will be part of the International Criminal Court cases.

The court’s field outreach coordinator, Ms Maria Kamara said in Kisumu on Wednesday that the 327 people will not be witnesses but their contribution could alter the nature of charges against the suspects.
“The victims may not necessary be aware of who was leading the perpetrators, but they are in a position to narrate what they went through, which the judges may use for the current charges or order the prosecutor to amend the charges,” Ms Kamara said.
She was at a training session for journalists from Nyanza and Rift Valley on the operations of the court.
She said that at next month’s appearance by Mr William Ruto, Mr Henry Kosgey and Mr Joshua Arap Sang, the prosecutor would not call live witnesses but will present his evidence in writing.
“The defence had initially lined up 48 witnesses, but they were told this was unnecessary at this point as it is not yet a trial,” Ms Kamara said.
The judges will look at the nature of the evidence after which they will either confirm or decline the charges in part or fully, ask for adjournment for further investigations or ask the persecutor to amend them.
