Two sue to block hiring of sugar board executive

TWO businessmen have sued Agriculture minister Sally Kosgei over the reappointment of Rosemary Mkok as Kenya Sugar Board boss. They claim the reappointment was illegal and want it quashed. Mkok was reappointed Kenya Sugar Board chief executive officer for three years beginning December 16, last year.
The two applicants Joshua Omanje and Augustinus Deya Hassan believe Mkok’s appointment and assumption of duty as CEO is not only illegal but also an abuse to justice and sugar cane farmers. They argue that corruption allegations against Mkok during her initial term must first be cleared before she can take up the job.
The two pleaded with the court to stop Mkok from conducting the business of the Kenya Sugar Board until corruption allegations of her initial term are cleared in the interest of justice. And in the event the court fails to stop her, they said, their case will be overtaken by events. They want their case heard as a matter of urgency.
In their suit papers, the two businessmen say at present there are no sitting members of KSB as the membership is subject to a high court case pending in Kisumu. The case in Kisumu is contesting the election of board members. It is argued that in the absence of a sitting board no other person or body can exercise the mandate of selecting or reappointing a CEO for the sugar board.
The minister exercised powers she did not have under the law and reappointed Mkok without regard to due process, the two argue. The position of CEO for the Kenya Sugar Board, they said, can only be filled after it has been advertised in the national media and candidates competitively interviewed. The case will be heard this morning.
