Tobiko decision awaited to resolve Goldenberg saga

THE Goldenberg scandal involving Sh5.8 billion has been in courts for 18 years because various applications. The case is against businessman Kamlesh Pattni and former Treasury PS Wilfred Koinange. Now the fate of that case lies with public prosecutions director Keriako Tobiko who is to decide whether or not to drop the criminal case against the three. The case has never been heard because of the numerous applications by both the defence and the prosecution.
The accused have claimed that the case has no complainant since the matter had been already settled. Also charged in the same case is former Kenya Commercial Bank general manager Elijah arap Bii. When the case came up for mention the last time, senior state counsel James Warui Mungai informed principal magistrate Grace Macharia that the DPP was asking for more time to decide whether to proceed or terminate the case.
Mungai told the court that there were negotiations going on with a view to finding a solution to the matter and requested that it be mentioned on January 30 for direction. At the same time, the magistrate terminated graft case against a former Central Bank of Kenya deputy governor Eliphaz Riungu who has since died. Riungu was one of the accused.
The magistrate also discharged two sureties of Sh12 million to those who had bailed out Riungu. Pattni has asked the court to terminate the case saying he had settled all the cases with the CBK who are the complainants. All the accused persons have denied conspiring to cause the government the loss of more than Sh 5.8 billion.
