Kenyans are waiting with baited breath to know the date when the next general election will be held under the new Constitution.
Supreme Court referred the matter to the Constitutional court in November 2011, after a dispute arose following a proposal of three different dates. That landmark ruling is expected on Friday.
With at least three scenarios advocated by three schools of thought, the Constitutional bench comprising Justice Isaac Lenaola, Mumbi Ngugi and David Shigomere is expected to take one of those schools of thought and lay the debate to rest.
The Elections date under the new constitution has in the last six months been in the minds and mouths of many a Kenyans, with the new Constitution clearly stipulating that the election should be held on the second Tuesday of August every five years.
Constitutional lawyer Oloo Onyango says that the Constitution should be read holistically arguing that most people have been ignoring the transitional clauses and stubbornly clinging onto the substantive articles of the constitution.
Onyango gave an example with schedule six of the new Constitution which saves the current life of Parliament.
Lawyer Milton Imanyara and Kilome Mwau sought the clarification of when the date of the next election will be in separate applications that were consolidated whose verdict will be delivered on Friday.
