AG accused of delaying devolution Bill

Two ODM legislators on Monday accused the Attorney General’s office of delaying the implementation of the new Constitution.
Lands Minister James Orengo and joint Chief Whip Jakoyo Midiwo said the Attorney General was deliberately holding the devolution Bill instead of forwarding it to Parliament for debate.
“The AG should be careful on the way he is handling the process of implementing the Constitution. Gone are the days when the AG played at the whims of the serving President,” Mr Orengo said.
He said the AG should recognise that the coalition government was being run by the two principals and his office should not be perceived as favouring one side.
Mr Midiwo faulted the AG’s office for trying to deny Kenyans a chance to reap the fruits of the new Constitution.
The two were speaking at Nyandusi ACK in Bondo District where they had accompanied Prime Minister Raila Odinga for a church service.
Last week, the Commission for the Implementation of the Constitution accused Attorney General Githu Muigai of disregarding Article 261 of the Constitution, which requires him to consult the commission before tabling Bills in Parliament. (READ: Nyachae and Githu clash over new laws)
However, Prof Muigai said he had no knowledge of advice given between his office and another, unless the correspondence had been copied to them.
“My role is to advise the government in confidence. That is part of the well know tradition of a lawyer and his client,” he said.
