THE High Court has certified as urgent a case filed by the ODM party seeking to kick out rebel members led by Eldoret North MP William Ruto and have them stripped of their parliamentary seats.
Yesterday high court judge Jeanne Gacheche said the case filed on Wednesday raises serious issues and directed ODM to immediately serve Ruto and his allies with court papers.
Lawyer Cecil Miller acting for ODM told Justice Gacheche that the party wants issues raised to be determined before the life of current parliament expires. Consequently Justice Gacheche directed the case file be placed before court on July 28 for hearing and further directions.
In the case Mpuru Aburi and Kepher Odongo claim that Ruto and rebel MPs Isaac Ruto, Joseph Kuttuny, Adan Duale and Charles Keter have abandoned the party and joined the United Democratic Movement in contravention of the constitution.
The two argue argue that the five MPs have publicly recruited members to join UDM and have also supported their rival, the Party of National Unity, in issues in which ODM has taken a contrary position. They say the five have breached the law on government political parties and ought to be kicked out. They also want the court to declare their parliamentary seats vacant in accordance with the constitution.

ReplyDeleteIt is better for ODM to have only 60 genuine Mps who are loyal to the party than have 120 disloyal, non law abiding members. Their conduct is anti-democracy and has been wanting,and it is time they were made to quit since their threats are not yielding fruit.
