International Criminal Court prosecutor Luis Moreno Ocampo wants Kenya to limit the head of civil service Francis Muthaura's powers over the police fearing he may interfere with witnesses.
Mr Ocampo also wants Deputy Prime Minister Uhuru Kenyatta stopped from interfering with witness protection since he sits on the board that oversees the programme.
At the same time, the prosecutor said the political debate around the Kenya cases may as well go on, but he has collected sufficient evidence to support the cases.
Addressing the media via a video-link, Mr Ocampo said Mr Muthaura remains in office as the Head of Civil Service which places him at the core of the national security system.
He will therefore write to the government asking that the two's influence over the police and the witness protection programme be limited.
Mr Muthaura and Mr Kenyatta are amongst six Kenyans who have been identified as most culpable over the post election violence that left 1,300 dead and 600,000 homeless following a disputed presidential election at the end of 2007.
The others are William Ruto (suspended Minister for Higher Education), Henry Kosgey (suspended Minister for Industrialisation), Hussein Ali (former Police Commissioner and currently Postmaster General) and Joshua Sang' (radio presenter).
All the six have been summoned to The Hague on April 7 after judges at the ICC's Pre-trial Chamber II found that there were grounds linking them to criminal involvement in the violence.
