KAMAU SAYS YES

Wakenya wenzangu,

I have read the so called contentious issues in the draft constitution and my conclusion is that, the church has lost direction. The church has lost touch with the common man or woman. Just consider these two issues:

1. In the proposed constitution, "Abortion is not permitted unless, in the opinion of a trained health professional, there is need for emergency treatment, or the life or health of the mother is in danger, or if permitted by any other law." What is wrong with this? How is this legalizing abortion? If the doctor determines that the pregnancy will cause the death of the mother, do we let her die? Does the current constitution legalize abortion? No. Actually abortion is a felony in our penal code! But are there abortions in Kenya ? Yes. What has the church been doing about that? Nothing or very little!

2. Kadhis' courts in the proposed Constitution under Article 169 and 170, limit their authority to disputes over personal status, marriage, divorce or inheritance, where all the parties are Muslims and agree to take the case to a Kadhi. Do you get that, “where all parties are Muslims and agree to take the case to a kadhi”? So why is the church so mad about this? Hii ni mambo ya waislamu! Pilipili usio ila, inakuwashia nini? These courts have been in the current constitution since independence. For the last more than 45 years, what efforts have the church made to remove the courts from the constitution? We have had MPs who were bishops, pastors, Fathers etc. Why haven’t they introduced a bill to strike off the kadhi courts from the current constitution? Can these church leaders give us examples of situations where the kadhi courts negatively affected their so called followers?

The church leaders do not want a new constitution. They see that the constitution will solve most of our problems. They don’t want that. If there are no problems in Kenya , they will not beg from their donors in pretext of helping the “poor”. You do the math.

IT IS TIME FOR CHANGE. LET US VOTE “YES” AND “YES” AND “YES” AND……..
