ODINGA'S ILLEGALLY ACQUIRED LAND

The High Court has issued an order stopping an MP from transferring some property in Kisumu he is alleged to have acquired illegally.

The temporary orders restraining Bondo MP Oburu Oginga were issued by the Kisumu High Court judge, Lady Justice Abida Ali Aroni, following an application by the Kenya Anti-Corruption Commission (KACC).

KACC sued Dr Oginga, together with Baringo Central MP Sammy Mwaita.

Seeking the orders against Dr Oginga, KACC said investigations had revealed that he fraudulently obtained the registration of the suit property, which belongs to Kenya Railways Corporation.

The land was surveyed in 1935 and set aside as part of the railway reserve and duly registered. Subsequently, the property was vested in the defunct East African Railways Corporation.

However, in 2001, Dr Oginga is said to have wrongfully procured a lease over the suit property from Mr Mwaita. The lease was registered at the district land registry in Kisumu on February 12, 2001.
