Saturday August 25, 2012 - The Embakasi MP Ferninard Waititu is loved and hated on equal measures but on Friday he won the smiles of over 3 million Kenyans.
The MP has now moved to court to stop the Communication Commission of Kenya (CCK) from switching off counterfeit handsets.
In his application filed under certificate of urgency, Waititu says shutting down counterfeit mobile phones will infringe on privacy and consumer rights.
He argues that millions of Kenyans bought the targeted handsets which were allowed into the country by the government.
Waititu says mobile phones are personal items that should not be arbitrated taken away without options of replacements.
“The regulator can enter into an arrangement with mobile phone companies for Kenyans to replace fake phones by December 31 2012,” reads part of Waititu suit.
The lawmaker says the country will lose Sh 60 billion if CCK goes ahead with the move.
The CCK has vowed to switch off close to 3 million fake handsets by September 30.
