CHIRAU Ali Mwakwere is still in TROUBLE


Monday 27th August 2012 – A Nairobi magistrate has issued a fresh summon to Environment Minister, Chirau Ali Mwakwere to appear in court on August 31 for charges.

Even though it is the duty of the Criminal Investigation Department to arrest Chirau Ali Mwakwere, CID boss Nicholas Kamwende has been reluctant to arrest him over hate speech even after the court order.

The High Court in July paved way for the arrest and prosecution of the Minister for hate speech after Justice David Majanja dismissed Mwakwere’s petition that sought to block the National Cohesion and Integration Commission (NCIC), police and the Director of Public Prosecutions (DPP) from filing charges against him.

Mwakwere is alleged to have made speech that bordered hatred during a by-election campaign in his constituency in July 2010, saying that indigenous coastal people have been oppressed by Arabs.

 It is the police who took the initiative to file charges against Mwakwere over the utterances he made during by-election in his Matuga Constituency in collaboration with National Cohesion and Integration Commission.

Mwakwere however refuted the claims stating that he was airing his views on the historical injustices suffered by his people, which is a constitutional right guaranteed to him under Article 27 of the Constitution.

Under the National Cohesion and Integration Act, making a speech that stirs ethnic hatred attracts a maximum Sh1 million fine, or three years in jail or both.
