Men charged with killing lawyer say they were tortured

Two men accused of violently robbing and killing a city lawyer on Monday complained that police had tortured them to make a confession.
Mr Paul Kilyungi Maluki and Mr Mutua Nzioki told the court that investigators had also forcibly taken their blood samples and fingerprints.
The claims were denied by the prosecutor, who said no blood samples or fingerprints had been taken from the two.
The prosecutor said that at the time the two men were remanded, it was after normal office hours and the samples required to prove whether they were the people who abandoned the lawyer’s vehicle could not be taken.
Mr Maluki and Mr Nzioki are accused of violently robbing Ms Rose Wathiru Waruinge on February 10 at her house on George Padmore Road in Kilimani before killing her.
They allegedly stole the lawyer’s car, a Subaru Impreza, a television set, two laptops, eight mobile phones, a radio and Sh73,000 cash.
The stolen property was valued at Sh1.6 million.
Police prosecutor Onesmus Towet said investigators had recovered the vehicle and were following leads that could result in the recovery of the other items, which he said might have been spirited out of Nairobi.

Chief magistrate Esther Maina remanded the two in custody until March 3 when the court will review their bail applications.
Ms Waruinge was in her house around 9pm when armed men stormed in and shot her dead.
They did not harm her son and other people in the house.
They drove away in her car, which was later abandoned on Desai Road in Ngara.
Ms Waruinge’s death came a few months after another lawyer, Mr Anthony Nahashon Ngunjiri, was shot dead while serving a court order at Nairobi’s Thome Estate.
In the same court, Mr Alimas Mohamed Said, Mr Samuel Kariuki Wambui and Mr James Nganga Mugo were charged with violently robbing Mr Nilkanth Rasikbhai Patel of a phone and laptop before shooting him.
They denied the charges and were remanded until April 3.

  3. Government of Kenya should have a well documented criminal data bases, and no murders coverups, stupid envy and endless corruption as government officials are well known for. STOP IT!!!!. ENOUGH IS ENOUGH!!!!!.Murderers should be executed and done away with FOR GOOD!!. Pole Ms Rose Waruinge you were one in a million, a source of inspiration and justice!!. You were one of the greatest Lawyers ever!!.The LSK should have something named after you and your husband for your legacy!.

  4. Hope there will not be ANOTHER murder coverup in this case. Let the big shots behind this murder, be brought to justice. We are not stupid we know, the two accussed are just a TIP OF THE ICEBERG. We want the big boses brought to justice. They can hide but ONE day they will be BROUGHT to justice. Mrs Rose Waruinge was a polite beautiful smart lady . God bless.
