Teachers get more time to file plea in Matemu suit

Teachers opposed to the appointment of Mr Mumo Matemu as head of Ethics and Anti-Corruption Commission have been given more time to file their submissions.
Mr Justice Isaac Lenaola directed the Kenya National Union of Teachers Nyamira branch to file further documents in support of their petition and serve the respondents before the case comes up for hearing on February 10.
The teachers claim that the nomination of Mr Matemu, Prof Jane Onsongo and Ms Irene Keino was flawed, irregular, unprocedural and unconstitutional.
Transparency and integrity
They are seeking a court order restraining the Chief Justice from swearing in the three pending the hearing and determination of the petition.
They argued that the appointment of Mr Matemu, Prof Onsongo and Ms Keino was in violation of constitutional provisions on transparency and integrity.
“Their appointment is contrary to Article 47 of the Constitution to the extent that it fails to provide reasons for their nomination,” read the petition.
Article 47 of the Constitution gives any person the right to be given written reasons for any administrative action that is likely to adversely affect them.
Parliamentary Justice and Legal Affairs committee declined to recommend their appointment because they “were not passionate about the corruption war”.
