MPs criticised for bypassing CIC on Bills

A lobby group has criticised MPs for passing two Bills in which the team implementing the Constitution was not involved.

The Decentralisation and Governance Non-State Actors (Degonsa) also said some of the Bills passed in the rush to beat last week’s deadline “do not meet the expected quality.”
Degonsa said passing the Contingencies Fund Management Bill and the National Government Loans Guarantee Bill without reference to the Commission on the Implementation of the Constitution had set a bad precedence.
Use all legal means
“We are putting the Executive and Parliament on notice that we will not condone violations of the Constitution and will use all legal means to prevent anyone from circumventing the law,” said the group’s chairman, Mr Stephen Mutoro.
The group also criticised the Treasury’s drafting of the County Public Finance Management Bill, which stipulates how county governments will manage devolved funds.
Degonsa said the Treasury appears to have misinterpreted how the funds will be remitted to counties.
The Bill has been the subject of a stalemate between Treasury and the Taskforce on Devolved Government.
