DC charged with relief food theft

Pokot district commissioner Nyamongo Nyabero has been charged with stealing relief food worth Sh1.2 million.
Mr Nyabero appeared before a Kitale court on Thursday and denied stealing 280 bags of maize from the government.
The DC was arrested on Wednesday at a private hospital in Kitale where he had been admitted for nearly two weeks after the alleged theft was exposed.
He appeared before senior principal magistrate Mary Chepseba where he was also charged with abuse of office and conspiracy to commit felony.
The offences were said to have been committed on July 29 in Kapenguria Township, West Pokot County.
Mr Nyabero was represented by Mr David Onyancha.
The magistrate declined a request by prosecutor Josephine Kemunto to have the accused remanded for two days arguing if released he would interfere with investigations.




“Your honour the accused person is a district commissioner and could tamper with vital documents at his office. I advice that he be remanded until Friday to allow police extract some crucial documents from his office,” Ms Kemunto said.
But Mr Onyancha opposed the request arguing his client suffers from diabetes and was under medical supervision.
The magistrate rejected the prosecution’s request and said she had considered the DC’s discharge medical summary and constitutional rights to release him on bond.
The DC has been in hospital suffering from malaria, and diabetic since two weeks after he was implicated in the relief food theft.
The court released Mr Nyabero on bond of Sh300,000 with surety in similar amount or cash bail of 50,000.
Ms Chepseba, however, ordered a 24-hour surveillance on the DC’s office and asked police to escort him to the office if they wanted to get some documents.
Mr Nyabero becomes the fifth person to be charged with theft of relief food. Those already charged include the Kapenguria National Cereals and Produce Board depot manager Charles Mosigisi.
