Pending court cases delay by-election

Kamukunji Constituency remains unrepresented in Parliament as two matters regarding its by-election are unsolved.

An appeal by the Interim Independent Commission (IIEC) against a High Court ruling that stopped the by-election failed to take off last Thursday, as the hearing was pushed to July 6.
The Nairobi constituency continues without an MP, at a time when Parliament is debating issues to do with the implementation of the new Constitution.
An aspirant, Mr Paul Waweru Mwangi, succeeded in stopping the by-election through a petition after his nomination papers were rejected by the electoral commission.
The High Court found that Mr Waweru, who was to vie for the by-election on a National Vision Party ticket, was denied a constitutional right to do so.
The court issued orders preventing the electoral commission from conducting a by-election in that Constituency until the aspirant’s suit is heard and determined.
However, that is yet to happen.
According to the appeal by the commission, if orders to lift the injunction are not granted soon, the constituency may remain without an MP until the 2012 general elections.
