New twist in Jirongo land case as DPP recalls file

THE Director of Public Prosecutions has recalled a case file in which Lugari MP Cyrus Jirongo sued a former associate for fraud 15 years ago.
The case came up for hearing yesterday before Kibera magistrate Benson Ireri but the prosecution said it is not ready to proceed as the file has been forwaded to the DPP for perusal. The DPP has powers to terminate a case where discrepancies arise. He may also trash a case where there is insufficient evidence.
In the case Eric Naibei, also a former aide of Gideon Moi, has denied selling a plot under the guise that Jirongo gave him the authority to dispose of it. Naibei was in court for the hearing which was adjourned awaiting word from the DPP.
The case involves a plot in Embakasi, Nairobi, registered under the MP’s company name but was was allegedly sold off to a city businessman for Sh3.7 million without his consent. Naibei has denied he fraudulently forged a title deed on February 25, 1994 in respect of the plot which he later used in a transaction. He is also charged with producing a  forged land transfer document purporting that he  had the authority to transact the land deal on behalf of Jirongo.
The case has dragged in court for the last 15 years with various objections lodged to block it before the attorney general finally  gave the nod to prosecute Naibei. Jirongo is the main prosecution witnesses in the case. The suspect is out on a Sh200,000 bond with a surety of a similar amount. The case will be mentioned on August 28.
