COMPLAINT: Ruto arrives at the High Court in Nairobi yesterday.
Suspended cabinet minister William Ruto has told court the Sh96 million fraud trial against him is a calculated move to ruin his career. Ruto has urged the trial court to set him and his co-accused free because the State has failed to adduce enough evidence to incriminate them in the Sh272 million Kenya Pipeline Corporation’s land purchase deal.“This is a classic example of an ill-advised prosecution designed and calculated to impair and ruin the respective careers, occupation and reputation of the accused persons,” reads his court paper.
And he says that “it is absurd and ridiculous to allege that Kenya Pipeline Company was mislead by falsely representations or pretences made after it had already purchased the property.
His lawyers Kioko Kilukumi and Katwa Kigen handed over written submission to trial magistrate Gilbert Mutembei and urged him to consider them while making a ruling on whether he should be put on his defense.
In his arguments, he says the prosecution has failed to establish a case against him, Joshua Kulei and the Baringo Central MP Sammy Mwaita and hence they should all be acquitted under the provisions of section 210 of the Criminal Procedure Code.
Lawyers acting for Berke Commercial Agencies, Priority, Celtic multi-systems and Somog Ltd and Sovereign Group companies have been associated with them for allegedly obtaining money from KPC in 2001 made a similar application.
Ruto argues that the charge sheet does not disclose the relationship between him or his co-accused and the four companies. According to the accused, no evidence was brought by the companies registry to link then to either of the companies.
