Ocampo welcomes Ruto’s bid to be heard on poll chaos case

International Criminal Court Prosecutor Luis Moreno-Ocampo has indicated that those feeling aggrieved by his filing of the Kenyan post-election violence case on Wednesday are free to object.

In a response to enquiries by the Nation over to moves seeking to stop his case, the prosecutor’s office welcomed them indicating that they were acceptable.
His office through an email from the media liaison officer, Ms Nicola Fletcher, said that “Mr (William) Ruto may take whatever legal action he believes is appropriate.”
The Eldoret North MP and senior security chiefs who were in charge during the violence have filed applications seeking to block the prosecutor from naming the six suspects on Wednesday.
Mr Moreno-Ocampo will hold a press conference at 5 pm local time and “make an important announcement concerning the investigation in the Kenya situation.”
It is expected he will make public his two cases on the post-election violence including the names of six suspects, which he files before the judges on the same day. The press conference will broadcast on the Internet through http://livestream.xs4all.nl/icc5.asx.
All indications are that the applications will be heard together with Mr Moreno-Ocampo’s when the judges sit to decide whether they will issue summons against the six Kenyans.
The applications by Mr Ruto and the PCs and PPOs are currently with the court’s registry after their lawyers filed them last week.
An official at the court’s Public Information and Documentation Section told the Nation on Friday that the applications will be part of the case once they reach the three-judge Pre-Trial Chamber.
Dr Fadi El Abdallah, an associate legal outreach officer, said that the submissions would have been uploaded on their website immediately.
“With regard to the mentioned request by the lawyers of Mr (William) Ruto, we are not aware of any public filing about this issue to the time being. Any public submission that might be filed is uploaded on our website with no delay,” Mr Dr Abdallah said in an email.
Mr Ruto’s lawyers, led by Dr Kindiki Kithure, said they had filed their case on Wednesday at the court’s registry.
Both applications want Mr Moreno-Ocampo stopped from naming his six suspects tomorrow until their submissions are heard and determined by the ICC judges.
Mr Ruto also asked the judges to compel Mr Moreno-Ocampo to “conduct his own independent, fair, impartial investigations and to stop depending on the reports of investigations done by others.”
