The State has withdrawn a criminal charge against Makadara MP Gidion Kioko Mbuvi.
Senior resident magistrate Timothy ole Tanchu allowed the application by the prosecutor, Superintendent Samson Kiptum.
Mr Mbuvi (left), popularly known as “Mike Sonko”, had been charged alongside Mr Afzal Ahmed Alihad and others with obtaining Sh1.05 million by pretences.
Mr Kiptum told the court that he had instructions from the provincial state counsel’s office to withdraw the charge under section 87 of the Criminal Procedure Code to allow the police to carry out further investigations.
Mr Jared Magolo, representing the MP, did not object to the application.
The case against Mr Ali, however, will continue and was fixed for hearing on October 25.
Mr Mbuvi’s supporters erupted into shouts and cheers of jubilation and carried him shoulder high as he left the court building.
Addressing journalists, the MP thanked God, saying the truth had prevailed.
The MP, with others not before the court, had been accused of obtaining the money from Ms Najma Ali Ahmed by pretending that they could sell her a piece of land.
The offence was allegedly committed on November 13, 2009 at Martin Tindi and Company advocates offices in Mombasa Town.
