Kenya MPs race to vet judges

Parliament’s Constitutional Implementation Oversight Committee (CIOC) meets on Monday afternoon to interview nominees to the team that will vet Kenya’s judges.

Parliament has until Wednesday to approve the nominees to the Vetting of Judges and Magistrates Board.
Those lined up for interviews this afternoon are Mr Sharad Sadashir Rao, who has been designated as the chairperson of the board, Mr Justus Maithya Munyithya, Ms Roseline Odhiambo Odede, Prof Ngotho wa Kariuki, Ms Meuledi Mabruki Iseme, and Mr Abdirashid Abdullahi as members.
Under the recently passed Vetting of Judges and Magistrates Act, the “President, in consultation with the Prime Minister and subject to the approval of the National Assembly shall… appoint three distinguished non-citizen serving or retired judges, each of whom has served as a Chief Justice or judge of a superior court in the Commonwealth, to be members of the Board.” (Read: Mutula says vetting of judges will be fair)
Monday's meeting takes place even as the House team awaits names of three foreign judges to help the six locals in fixing the mess in the judiciary and put it on a reform path. The CIOC has been pushing the executive to present the names of the three foreign judges and has even threatened to sanction the executive if the names are not presented to the House. As of Thursday last week when the committee last met, it had not received the names.
House Speaker Kenneth Marende had asked President Kibaki and Prime Minister Raila Odinga to submit the names because the nine-member board would not be complete unless the foreign members are appointed and approved at the same time as the locals. “It must be noted that in order for the Committee to properly consider the suitability of the nominees proposed against the statutory and constitutional requirements as to appointments to public office, the Committee may require to have the full picture of all the nominees proposed,” the Speaker said then.
