Yet another Kenyan MP has joined the growing list of legislators to lose their seat in election petitions.
Gatundu North MP Clement Waibara Friday became the 12th MP in the Tenth Parliament to have his seat nullified over poll irregularities in the 2007 General Election.
High Court judge Fred Ochieng said the defunct Electoral Commission of Kenya (ECK) did not comply with the law since the presiding officer did not sigh Form 16A as required.
He therefore ruled that the ECK be held accountable for this serious omission.
Other legislators who lost their seats include: Joel Onyancha (Bomachoge), Omingo Magara (South Mugirango), Chirau Mwakwere (Matuga), Simon Mbugua (Kamukunji), Dick Wathika (Makadara), George Thuo (Juja), Margaret Wanjiru (Starehe), Ngata Kariuki (Kirinyanga Central), Boni Khalwale (Ikolomani) and Abdirahman Hassan (Wajir South).
Only Mr Mwakwere, Mrs Wanjiru and Mr Khalwale made it back to Parliament in the subsequent by-elections.
