Ruto: Name poll chaos ‘foot soldiers’

Suspended Cabinet minister William Ruto wants the ICC prosecutor to disclose the identity of all people he alleges were used to execute the post-election chaos.

The letter by Mr Ruto’s lawyer, who also represents radio presenter Joshua arap Sang’ was dispatched to The Hague as Prosecutor Luis Moreno-Ocampo sought more time to evaluate the security of witnesses in Kenya before disclosing evidence to defence teams.

In the Tuesday letter to the prosecutor, lawyer Joseph Kigen-Katwa, wants the names of the perpetrators to be included in the evidence that Mr Moreno-Ocampo has been directed by the Pre-Trial Chamber to disclose to the defence teams by next Friday.

Mr Kigen-Katwa submits that the disclosure of the identities of the persons who are alleged to have been used by his clients will help the defence teams in the preparations for the confirmation hearings set to begin on September 1.

The move could lift the lid on the contents of the secret Waki envelope, which contained the names of people the Commission of Inquiry handed to the prosecutor. It could also reveal other perpetrators Mr Moreno-Ocampo has stumbled on in his investigations.

“The defence teams of Mr Ruto and Mr Sang’ are writing to you in order to seek further information concerning the identity and role of perpetrators, coordinators and commanders referred to in the Prosecution Application for a Summons (the Application), which the defence considers to be material to its preparation for the confirmation hearing,” he writes.

Deputy Prime Minister Uhuru Kenyatta, Tindiret MP Henry Kosgey, Public Service boss Francis Muthaura and Postmaster-General Hussein Ali complete the list of the Ocampo Six.
