ODM has said the controversial judicial nominations are being rushed to hoodwink the world that Kenya has the capacity to handle post-election violence cases.

The 56 MPs, who met at Orange House, yesterday, resolved to block the deferral bid. They said they would not watch as attempts to stump out impunity are stifled.
Yesterday, Immigration Minister Otieno Kajwang’ said the move by President Kibaki to nominate Alnashir Visram as Chief Justice, Kioko Kilukumi as Director of Public Prosecutions and Githu Muigai as Attorney General is unconstitutional and should not be debated in Parliament.
"We expect no debate on the reports because the House cannot debate reports that are unconstitutional," said Kajwang’.
Unconstitutional
Parliamentary Committee on Justice and Legal Affairs is expected to table its report on the three nominees today while the Committee on Finance, Trade and Planning tabled its report on the nomination of William Kirwa as Controller of Budget, yesterday.
The ODM legislators said they are ready for anything that would happen on the floor of the House but said they do not expect the matter to go to voting, as it is unconstitutional.
"We don’t expect a debate and therefore we don’t expect a vote. If we were to vote it would be a disaster because we would be voting on an issue that is unconstitutional," said Kajwang’.
Energy Assistant Minister Mohamed Mohamud said ODM would not compromise on matters regarding the implementation of the Constitution.
The ODM MPs said they stand for justice and would not let Kenyans down by allowing a few individuals lead attempts to entrench impunity.
"At the meeting we were unanimous that ODM must support all efforts to end impunity and that is what Kenyans want," said Vihiga MP, Yusuf Chanzu.
