The court will rule this week if TNA should present Sakuda’s nomination to the IEBC/File photo.
Nine presiding officers on Sunday alleged that the nominations – held last week – were manipulated in favour of Tirus Ng’ahu, who clinched the TNA party nomination.
One of the officials, Samuel Karanja claimed that Ng’ahu did not win fairly because the process was manipulated.
He told a press conference in Murang’a on Sunday that a rule barring members who were registered after August 10 from voting was violated, because none of them was supposed to be allowed to participate.
Ng’ahu, who was last week endorsed by the family of the late Environment Minister John Michuki, emerged victorious beating seven other contestants for the TNA ticket.
Duncan Mwangi was second with 3,283 votes, while Muturi Kigano emerged third with 2,332 votes.
Kirima Ann Wangare was fourth after garnering 1,714 votes.
The seat fell vacant following the death of John Michuki, who had served the constituency for more than 15 years.
TNA results from the nomination were transmitted directly from the constituency and ward tallying centres to the national headquarters in yet another show of embracing technology.
The party, associated with Deputy Prime Minister Uhuru Kenyatta, suffered a setback on Friday after the High Court issued an order barring the party from presenting its nominee for the forthcoming Kajiado North by elections to the Independent Electoral and Boundaries Commission (IEBC).
Vacation judge Justice Alfred Mabeya issued the order after the aggrieved candidate Francis Gitau Parsimei moved to court to stop the nomination of his rival Moses Ole Sakuda.
Parsimei told the court that the exercise was not conducted in a transparent manner as most of the people who voted for Sakuda were not members of TNA.
The court held that pending the hearing and determination of the petition, IEBC should not receive the nomination of Ole Sakuda as TNA’s preferred candidate for the mini poll.
The hearing for the case is scheduled for Wednesday this week.
Ole Sakuda emerged victorious in Kajiado North with 16,130 (90 percent of the vote) followed by his only challenger, Parsimei, who got 1, 677 votes.
Political parties are expected to present their nominees to the IEBC between Thursday and next Sunday.
