The Political Parties Tribunal which was formed early last year to arbitrate party disputes is likely to be swamped with scores of complaints once parties conduct nominations for the various by elections which are due to be held soon. But whether the tribunal will be able to act on these complaints is another matter altogether. Almost two years after it was established, the tribunal is yet to receive a single cent for its activities. We are even told that three members of the tribunal have been taking turns to fund some of the tribunal's activities even though they are not even sure whether they will be refunded the money!

A few months ago Augustino Netto was a little known activist.However, he has gained stature when he and two other voters filed a suit to challenge the eligibility of Deputy Prime Minister Uhuru Kenyatta and Eldoret North MP Willian Ruto to contest the presidency on integrity grounds. Early this week, he won the ODM nomination for the Ndhiwa parliamentary seat. His nomination coincided with the decision by the courts to enjoin ODM party leader Raila Odinga, Deputy Prime Minister Musalia Mudavadi and Vice President Kalonzo Musyoka in the eligibility case. Neto is now facing a dilemma— withdraw from the eligibility case and at least get an assurance of being elected or continue with the case and face a resounding defeat at the polls. Our moles tell us that Neto has disowned the petition enjoining Raila and the others in the eligibility case and is in the next few days expected to instruct his lawyer to formally withdraw the case.

The expanded eligibility case which ropes in VP Kalonzo Musyoka is giving his strategists sleepless nights. They are worried that the contempt of court decision might be used by his opponents to lock him out of the presidential race and are considering the different ways they can counter this.

The ODM political aspirant who stormed Orange House and repainted it despite appeals by the officials that he should not has rebuffed attempts by various party leaders to prevail upon him not to run for the newly created Embakasi East parliamentary seat.The man is admant that democracy should be allowed to prevail in the party and has insisted he will not withdraw.
