Rawal denies investment scam

NAIROBI, Kenya, May 6 - High Court Judge Lady Justice Kalpana Rawal's race for the top judicial job was on Friday put to test, as she faced accusations of participating in an investment scam alongside some members of her family.
Judicial Service Commission (JSC) Chairperson Prof Christine Mango said they had received complaints that Judge Rawal was involved in the fraud together with her husband and son.

"Complains received from the Association for Business Managers show that together with your husband you have masterminded an investment scam that fleeced the public of their savings and that you used your son and husband as a cover up," she said.

She denied participating in the scam as she defended her suitability to be appointed the next Chief Justice:  "I have no idea about that at all and I deny totally."

The Judge was also alleged to be temperamental, impatient and had no respect for young lawyers.

"There is a view that you are not fit to hold the office because you are temperamental; you have a problem with grasping the law and you bulldoze issues," Prof Mango stated.

In her defence, she said people had to be hard-pressed if they failed to do what was expected of them and also denied that she was temperamental.

She was also viewed to lack independence in her judgments which was seen to weaken her capability to reform the Judiciary.

Judge Rawal said with 11 years experience as a judge and 28 cumulative years in law practice, she had what it takes to become Kenya's next Chief Justice.

Justice Rawal is one of two female applicants for the top Judiciary job.

She became the 7th candidate to appear before the JSC panel out of the 10 candidates short listed for the interviews.

The interviews that kicked off on Tuesday will end next Tuesday.

Justice Paul Kihara was set to appear before the panel on Friday at 2.30pm.

Others who have already appeared before the Commission are President Mwai Kibaki's nominee for the job, Court of Appeal Judge Alnashir Visram who was the first to be interviewed.

Others are Dr Willy Mutunga, Court of Appeal Judges Samuel Bosire, Joseph Nyamu, and Riaga Omollo.
