Politician gets three years jail over SMS

A Lamu politician has been sentenced to three years imprisonment for sending threatening messages to two members of Parliament.
Rishad Hamid, popularly known as Rishad Amana, was convicted on two counts of sending SMS threats.
A week ago, Mombasa chief magistrate Rosemelle Mutoka found Hamid guilty of sending the threatening messages to Lamu West and Lamu East MPs Fahim Twaha and Abu Chiaba.
She asked for a probation report before passing the sentence.
Ms Mutoka noted that the offence was becoming prevalent and needed to be discouraged.
Hamid’s relatives and friends, who packed the court room, broke into tears when the magistrate read the sentence.
In mitigation, Hamid said he was remorseful and that a custodial sentence would be detrimental to his health.
Ms Mutoka acquitted co-accused Athuman Kibwana.
She noted in her ruling that the prosecution had proved the case against Hamid but failed to prove the case against Mr Kibaba.
Mr Hamid committed the offences on diverse dates between June 22 and July 27, 2008.
Prosecutor Samson Kiptum urged the court to treat the accused as a first offender since he had not received any previous records against him.
Among the prosecution witnesses in the trial, which lasted almost two years, were the two MPs and an inspector of police attached to Parliament police station.

  1. I do agree what Mr amana did was wrong, However i dont understand why the MPs had to wait for 3yrs to prosecute him. Is it because we have an election next year? I hope the MPs will think about this and put themselves in his position for the sake of his kids because they are the ones who will get hurt, If they have a human heart I believe they should shake hands like true politicians forgive each other and who knows may be something good will come out of it.
