Ethnic balancing will not lead to sackings

No civil servant will be sacked over ethnic imbalance in the public sector.

The National Cohesion and Integration Commission (NCIC) said the planned staff rationalisation was only meant to give public offices a national face.
Addressing the Parliamentary Committee on Equal Opportunities, NCIC chairman Mzalendo Kibunjia said the ethnic audit of the civil service released last week highlighted the injustices in the system.
“No one will lose their job because of their tribe, all we want is a redistribution so as to balance and give the government a true face of Kenya,” Dr Kibunjia said.
The study found Kikuyu and Kalenjin communities dominate the civil service, with up to 40 per cent of all jobs.
The most affected institutions are State House, Local Government, Transport, Public Service, Higher Education, Tourism and Nairobi Metropolitan.
The report blamed the rot on political patronage from State House since independence.
On Thursday, the committee said it would pursue the matter with the affected ministries.
“This is the start, we want to meet all the ministries concerned, we want to correct the anomaly and look at the one third rule strictly,” Dr Kibunjia said.
The NCIC Act 2008 stipulates that not more than a third of employees in any public department should be from one tribe. The commission has recommended reshuffling of public servants to comply with the law.
The law was enacted in 2008, and Dr Kibunjia said beneficiaries of the flawed system would be spared the sack as the law cannot be applied retrospectively.
Parliament’s Equal Opportunities Committee chair Mohammed Affey said the team also proposed that no one loses their job because of the imbalance as it was not their fault.
