Prezzo mother's relief in Sh65million property row

THE mother to Kenyan celebrity musician Jackson Makini popularly known as Prezzo is off the hook after the High Court set aside a judgment against her in Sh65 million property dispute. If the court had issued the judgment on eviction notice, she would have been rendered homeless. Justice Philomena Mwilu gave Bhoke the go ahead to file the relevant documents for the case to proceed into full hearing.
The case will be heard on November 20. Prezzo's mother, moved to court in June this year  stop the court from granting the judgment as sought by John Njuguna Nduati. She claimed to reside in the house situated in Kilimani area, but had put it up for sale two years ago for Sh26 million. Nduati was interested in the house and made a down-payment of Sh3 million.
The agreement was that the buyer would complete the balance within 90 days. She says he defaulted in paying the amount. She was later surprised that Nduati had filed a case in court and was awaiting judgment. In the court papers, Makini says she got wind of the case through a friend who allegedly spotted her name in the court's cause list.
Through her lawyer Evans Ondieki, Makini stated that she was never served with the papers and it would be against the principals of common law for the judgment to be delivered without hearing her side of the story. She claims that although Njuguna knew where she resided, he never served her with the court papers. Makini argues that she will be rendered destitute if her properties are taken away, adding that her children will suffer irreparable loss, which will not be compensated in monetary terms.
