Cracks emerge in presidential aspirants’ case

A suit challenging the suitability of the big five presidential contenders took a different turn after some of the applicants sought to have the names of Prime Minister Raila Odinga and Vice-President Kalonzo Musyoka expunged.
Three litigants led by Augustino Neto, the ODM candidate for Ndhiwa by-elections, claim they were not consulted when Raila and Musyoka’s names were added in the case filed in January.
They say their first case was challenging the suitability of Deputy Prime Minister Uhuru Kenyatta and Eldoret North MP William Ruto.
Mr Neto filed the first case together with seven others questioning the candidature of Uhuru and Ruto, who are facing charges of crimes against humanity at the International Criminal Court. But fresh papers were filed this month amending the petition to include Raila, Kalonzo, and Deputy Prime Minister Musalia Mudavadi.
The petitioners want the court to decide whether the presidential aspirants meet requirements of Chapter Six of the Constitution on leadership and integrity due to various allegations of corruption and nepotism.
 They also want the court to facilitate their investigation into Raila’s academic background, given the fact that any presidential candidate must now be a holder of a university degree from a recognised university.
The move has split the applicants, with five maintaining the papers should remain as amended.
