Kiyiapi wants court to clarify integrity law

James ole Kiyiapi, a presidential aspirant, wants the Supreme Court to interpret the provisions of Chapter Six of the Constitution on leadership and integrity.

The Restore and Build Kenya party leader, Prof Kiyiapi said Parliament could not be trusted to write the law which parliamentarians have an interest in and that the court was a legitimate alternative route to deriving law from the Constitution.

He said Parliament had failed to fast-track the Leadership and Integrity Bill 2012, currently being fine-tuned by the Justice and Constitutional Affairs ministry and the Law Reform Commission.   

The Bill, published in February, sets out stringent conditions for those seeking elective positions and could lock out of the race dozens of aspirants for presidential, county and parliamentary seats in the forthcoming General Election.

“The chapter is the moral anchor of the new Constitution, but only a law would clarify what it exactly means as it will define the limits,” Prof Kiyiapi told the Sunday Nation in an interview.
