VERDICT

IN THE MATTER OF DISCIPLINARY PROCEEDINGS AGAINST HON. EPHRAIM MAINA, MP
FOR VIOLATIONS OF THE SAFINA PARTY CONSTITUTION AND CODE OF CONDUCT
Nairobi 11th October 2011

    Verdict
•    Hon. Ephraim Maina, a member of Safina Party and also Member of Parliament
for Mathira Constituency has failed without apology or explanation to appear
before a disciplinary panel to which he was summoned in writing.
•    Safina is a political party with a Constitution and rules for all of its
members, and the disciplinary panel before which Hon. Ephraim Maina failed to
appear is duly constituted under the Constitution of Safina, Article 5 of which
provides for the rights, duties and discipline of members.  The disciplinary
panel constituted under the Constitution of the Party comprised three members
chosen from among the Elected National Officials namely;  Mwalimu Mati the
Chairperson, Dinah Awour the Vice Chairperson and Rashid Mohamed Diis the
Chairperson of the Workers Council of Safina Party. 
•    The proceedings ensued in the absence of Hon. Maina after the Panel
satisfied itself that he was duly served with the charges against him by the
Secretary General’s office.  The charges and evidence were considered by the
panel.
•    Two letters were delivered to the Hon. Maina by the Secretary General – on
6th September 2011 and 4th October 2011.  The first makes allegations of
misconduct by Hon. Maina as a member of Safina party and invited him to show
cause as to why disciplinary proceedings should not be brought against him;
while the latter served him with notice of the date, time and venue of these
disciplinary proceedings this morning.  Hon. Maina refused to avail himself
before this panel of the opportunity to defend himself against the allegations
and charges against him as provided for in Article 5 of the Safina Party
Constitution.  The evidence against Hon. Ephraim Maina is documented in print
and film.
•    The disciplinary panel therefore finds the Hon. Maina guilty as charged and
unanimously makes the decision to take immediate action against Hon. Ephraim
Maina for the following breaches of Party Discipline
