  1. In addition to prosecution powers conferred to the Director
    of Public Prosecution (current Constitution Articles 157 (4), 157 6 (a)), in article 259 3 (d)
    The Constitution states, “a reference in this Constitution to an office, body or organisation is, if the
    office, body or organisation has ceased to exist, a reference to its successor
    or to the equivalent office, body or organization” The office, body, and
    organisation formerly UNDER AG in conducting prosecution and directing
    investigations ceased existence and taken over by DPP. Therefore, it is
    immaterial that ACT ON EXTRADITION refers to the AG and not DPP. Moreover, Under
    Article 2 (5), Article 2 (6) and 50 (n) (ii) of The Constitution of Kenya, extradition
    is a constitutional obligation of the State and the Sovereign (people of
    Kenya). HAWA JAMAA WAENDEE!
