UHURU KENYATTA’s ICC case takes a new turn as witness 4 (MAINA KABUTU) is dropped (STATE HOUSE MEETING with MUNGIKI link)




Wednesday February 6, 2013 - The credibility of International Criminal Court (ICC) has been put on the spotlight by Deputy Prime Minister Uhuru Kenyatta’s defence lawyers after evidence adduced by witness number 4 was dropped by The Hague based court.

In an application filed at the Trial Chamber V on Tuesday, Uhuru argues that the prosecution used evidence presented by witness number 4 (alleged to be James Maina Kabutu) whose testimony was dropped by the prosecution and  it was entirely used upon to commit Uhuru to full trial last year.

The Pre-Trial Chamber heavily relied on witness, Maina Kabutu who later retracted his statement that Kenyatta and former Head of Civil Service Francis Muthaura attended the meeting in which they met Mungiki members and directed them to carry out attacks.

Uhuru’s lawyers have petitioned ICC judges to immediately stop his case and refer it back to the pre-trial chamber judges where they will seek to drop the whole case for lack of evidence.

This is because witness 4 statement was relied on entirely by the Pre-Trial judges in their verdict to confirm the charges against Uhuru and Muthaura.
