Deputy Prime Minister Uhuru Kenyatta’s The National Alliance party has threatened to sue the electoral commission and its officials over claims of unfairness and questionable tender deals.
A letter written by the party’s secretary for legal affairs Jasper Mbiuki and treasurer Wambuki Gichiru is accusing the Independent Electoral and Boundaries Commission (IEBC) of being partisan.
The two TNA officials also claimed that the IEBC had offered a lucrative civic education tender worth Sh300 million to a company associated with ODM official John Kiarie.
But Friday the IEBC chief executive officer James Oswago dismissed the claims as far-fetched and malicious adding that the tender was entirely handled by the United Nations Development Programme and not the commission.
“These claims are malicious and entirely unwarranted. We do not fund any political party. We have contacted the UNDP regarding this tender because they handled it and we have been told it was above board,” Mr Oswago said.
Mr Kiarie also told the Saturday Nation that he was shocked to learn about the tender claims on social media and denied being a director in the said company adding that the allegations were part of wider propaganda schemes to discredit the ODM leadership.
“I am not a director of the company that benefited from the tender. The records are clear and any attempt to associate me with it can only be malicious,” he said.
The TNA letter also claimed that IEBC has been lenient on Cord.
“We have written dozens of letters attaching photographic and audio visual evidence of infractions but the IEBC has done nothing,” TNA claims.
It also claims a consultancy firm associated with a Nairobi based ODM politician was awarded a multimillion tender that they argued amounted to indirect funding of their opponents, which is against the law.
Threat to sue
“Your organisation shall immediately cease funding ODM and Cord or we shall take legal actions not only against IEBC as a body but also commissioners in their individual capacities,” said the letter.
Friday Mr Mbiuki confirmed that he is one of the authors of the letter dated February 15 and marked received by the IEBC on February 19.
