Thursday 6th September 2012 - The government has warned that it will charge up to sh5m to individuals found promoting hatred through mobile phone text messages.
The national steering committee involved in media monitoring said technology will be used to pick up any abusive messages or those that inflame hatred and incitement.
“Those charged with the offence will be liable for prosecution and may be subject to extremely high fines, some as high as sh5 million and above,’’ said Omwa Ombara, the acting director of communication in the committee.
She said that the committee is still holding consultation on a proposed law to subject those who abuse mobile phone text messaging and the internet to propagate hate speech to heavy fines.
According to the new rules drafted by the Communication Commission of Kenya, political parties will also be required to submit political messages for approval by mobile phone operators 48 hours before they can be sent out.
The new rules also state that the political messages will be only in either Kiswahili or English. The CCK also went ahead and gave a time frame which is within 6am and 6pp and that the transmission must also comply with the laws of political campaign periods.
The move by Communication Commission of Kenya is aimed at controlling political messages during the March 2013 elections campaign period. The commission had invited the members of public to give their views on the draft guidelines before Tuesday next week.
