Deferral not on UN's security council agenda

KENYA’s hope for clinching a UN Security Council deferment for the post -election case appears dim as the matter is not listed in the council’s programme of work for March.
And since the pre-trial judges are expected to make a ruling on the prayers sought by prosecutor Luis Moreno-Ocampo by the end of this month, it means by the time the deferment is discussed, if it will ever be, the horse will have bolted.
According to the provisional work programme of the council, the only item closer home is discussions on Somalia whose report “comprehensive strategy for the realization of peace and security in Somalia” will be debated on March 10 and voted on March 17.
Other countries in Africa which are listed in the programme are Cote d’Ivoire, Libya, Sierra Leone, Eritrea and Sudan in regard to matters already taken up by the council.
“The forecast covers in particular those matters that may be taken up during the month pursuant to earlier decisions of the Council.”  “The fact that a matter is or is not included in the forecast carries no implication that it will or will not be taken up during the month: the actual programme of work will be determined by developments and the views of members of the Council,” the Council websites however states.
Sadly for the Kenyan government, the matter will miss its hearing at a moment when the Security Council presidency is being held this month by China, a country which has openly stated support for Kenya.
The programme, which was drawn up on Wednesday, comes at a time when Vice President Kalonzo Musyoka is said to be planning another round of “shuttle diplomacy” targeting the 15 Security Council members.
The 15 include the five permanent ones US, UK, France, Russia and China all which wield separate veto powers and Bosnia and Herzegovina, Brazil, Colombia, Gabon, Germany, India, Lebanon, Nigeria, Portugal and South Africa.
