Mbugua loses Kamukunji seat

NAIROBI, Kenya, Jan 27 - Simon Mbugua has lost the Kamukunji parliamentary seat in an election petition.

Mr Mbugua becomes the eighth Member of Parliament whose 2007 election has been nullified over election malpractices.

The petition was filed by Orange Democratic Movement aspirant Ibrahim Ahmed who lost the poll.

In her ruling Justice Mary Angawa ruled that there was no valid result in the poll.

The petition has dragged for three years with complaints of 'delaying tactics' as a result of several applications.

Following the endorsement of the new Constitution, Mr Mbugua had argued that current judges were not competent to hear the case until they are vetted afresh.

The hearing of the Kamukunji election petition stalled further after the two judges hearing the case disqualified themselves from the case.

In October last year Justice Fred Ochieng' disqualified himself after remarks were made against him suggesting that he had been influenced.

In June, Justice Rawal pulled out of the case after receiving threatening messages from unknown persons.
