Court to rule on referendum case Thursday

The Independent Constitutional Dispute Resolution Court will Thursday afternoon rule on whether to strike out an application seeking to stop the referendum.

Through their lawyers, the Interim Independent Electoral Commission, the Attorney General and the Committee of Experts argue that the court has no jurisdiction to determine the matter.

Six people among them activist Omtatah Okoiti who have filed the case want the referendum to be postponed to allow Kenyan's in the Diaspora to register.

Through their lawyer, the activists argue that the court has the power to hear and determine the matter.

They also want the AG, the IIEC and CoE barred from conducting partisan civic education.

IIEC through lawyer Githu Muigai told the court Wednesday that every order sought by the applicants lies beyond the scope of parliament arguing that the case brought before the resolution court has no merit and should be struck out.
