NAIROBI; KENYA: The estranged wife of former Rarieda Member of Parliament Raphael Tuju is embroiled in the corridors of justice as she was arraigned in Court to face a criminal case of assault against a watchman.
Ruth Wanjare Akinyi pleaded not guilty of charges that on 23rd August 2013 at Localine Garden in Upperhill within Nairobi County, she assaulted Felix Omondi Obuodha.
She was charged of assaulting a night watchman at 2340 hours contrary to section 251 of the penal code laws of Kenya and resulted into actual bodily harm.
The watchman claims to have been assaulted by Ruth Wanjare and was examined by a police doctor and was issued with a P3 Form for investigations.
Fred Omondi, a guard at Lacoline Gardens along Masaba Road, was examined at Nairobi Traffic Area where the doctor indicated that he had suffered injuries on the left leg with browses on left thigh and upper left limp.
Arraigned before chief magistrate in Milimani law courts, Akinyi pleaded not guilty of the charges.
Through lawyer Ian Mbugua, she applied for a cash bail and also requested the court to grant witness statements and any evidence the prosecution may want to use.
During the court session, Akinyi covered her head even as the members of the press strained to take her pictures in the docks.
According to the doctor’s reports under the prosecution, it indicates that the watchman had suffered chest pains when he fell on the ground following the Friday night incident.
Omondi recorded statements at the Capital Hill police station, he claimed that Ruth drove into the gate while he was opening and knocked him down causing him bodily harm.
The guard reported that Ruth who also stays at the apartments did not bother to check his status and was given first aid by another tenant who came to his rescue.
Ruth has denied to knowingly hurting the watchman and claims she simply hit the gate to escape from robbers who were trailing her as she returned home.
She said that she was attacked and yet the watchman was slow in opening the gate.
However, the guard reported the incident to his bosses and proceeded to the police where he made the report.
Akinyi was granted a cash bail of Sh50,000 and the case filled in the courts registry as number 1372/18. The case is set for hearing on 28th November 2013.
