Dr. WILLY MUTUNGA now accuses KIBAKI of being behind IMPUNITY.




Friday September 21, 2012-Chief Justice Dr Willy Mutunga has launched scathing attacks to President Mwai Kibaki, accusing him of being major obstacle to the ongoing Judiciary reforms.

In a letter to Law Society of Kenya responding to the issue of “sacked judges who are still receiving salaries”, Mutunga said he wrote a letter to the President Kibaki requesting him to gazette their retirement but he didn’t act on it.

“I wrote a letter to the president to gazette their retirement,” Dr Mutunga said.

Mutunga’s remarks were supported by Chief Registrar of Judiciary Gladys Shollei, saying the CJ wrote to the President on August 8, the same day he received communication about the unsuitable judges.

 Shollei said the Judicial Service Commission (JSC), which Mutunga chairs, has no power under the Constitution or any other law to remove judges from office. 

The Registrar said the law is clear that judges who are found unfit shall be deemed qualified for early retirement.

Justices Riaga Omolo, Samuel Bosire, Emmanuel O’Kubasu, Joseph Nyamu, Mohammed Ibrahim, Roseln Nambuye and Jeane Gacheche are still earning their salaries despite being declared unfit to serve in the Judiciary.
