Judge Orders Attorney General, Minister for Finance and Controller of Budget to
appear before her tomorrow.

Mars Group Petition 271 of 2012, Jayne Mati v Attorney General, Minister for
Finance and Controller of Budget, was heard by Justice Mumbi Ngugi this
afternoon (26 June 2012).

The Judge certified the matter urgent and ordered that the matter be heard inter
partes (all parties present) tomorrow morning at 9am.

The Minister for Finance stood on the floor of the National Assembly half an
hour later and informed the House that he had just published the Appropriations
Bill 2012 "in compliance with section 222 of the Constitution".  This statement
by the Finance Minister confirms that indeed there was no Appropriation Bill
when he moved the Motion on Vote on Account on 21st June 2012.

Mars Group's position is that the Motion on Vote on Account of 21st June 2012 is
a nullify, illegal and unconstitutional.  In our view, the Finance Minister must
bring the Bill he says he has published to the National Assembly, and bring his
request for a Vote on Account afresh.  This will be our argument in Court
tomorrow morning.

We do not want Government to shut down.  We just want money to be withdrawn from
the Consolidated Fund within the Constitution, and not in the arbitrary manner
used in the past.
