Ruto to seek acquital in fraud case

Eldoret North MP William Ruto will today seek for an acquittal in his Sh96 million fraud case. Ruto made his intention known in court yesterday after the prosecution formally closed its case after calling 20 witnesses to testify against him, and his co-accused Joshua Kulei and the Baringo Central MP, Sammy Mwaita. “I have instruction to move under section 210 of the criminal code procedure and seek for acquittal,” lawyer Kioko Kilukumi told court yesterday evening. Section 210 provides for an acquittal of accused person when there is no case to answer. The trial over the alleged sale of land in Ngong forest started in January.

The three are charged alongside Berke Commercial Agencies, Priority, Celtic multi-systems and Somog Limited and Sovereign Group, companies associated with them. They allegedly obtained money fraudulently from Kenya Pipeline Company in 2001.

Yesterday, the prosecution wound up its case after Kennedy Wanjala, a superintendent of police who investigated the alleged fraud gave his evidence.

Wanjala, now the Homabay deputy police boss said he and others were instructed to investigate the alleged sale of forest land in May 2003 by the director of CID Francis Sang.
