MPs move to court to get Sh160m from State

By Evelyn KwambokaA section of politicians want the court to set aside orders stopping the Government from paying them Sh160 million.
Former East African Legislative Assembly (Eala) MP Gilbert Ochieng Mbeo claims no court has issued an order declaring the National Assembly Clerk Patrick Gichohi a beneficiary of the said funds, to warrant the stoppage.
"There has never been any proceedings between the clerk and any of the claimants in any court of law within the jurisdiction of Kenya, hence no such order can exist," he claims.
In an affidavit filed at the High Court registry, Mbeo says the clerk obtained the stoppage order without disclosing to High Court judge George Dulu that he did not have a local order to attach a debt the politicians allegedly owed him.
On her part, Ms Yvonne Khamati said the law firm of Kajwang’, and not Mutula Kilonzo and Company Advocates, is representing the politicians.
The Sh160 million was awarded to former Medical Services Minister Anyang’ Nyong’o and his group by the East African Court of Justice, last year.
Mr Gichohi then moved to court in March, where he obtained interim orders on grounds he would not recover money from the politicians if the Government paid them.
The clerk, who was among those sued by the politicians in the case that challenged the nominations of Kenyan representatives to East African Legislative Assembly, was removed from the case by the court.
