LSK puts traffic boss on notice over road carnage

The Law Society of Kenya has given Traffic Commandant Samuel Kimaru 30 days to explain why proceedings to remove him from office for incompetence should not be instituted.
The terse letter from the lawyers lobby comes in the wake of a grisly road accident on the Nairobi-Narok road that claimed 41 lives, after a bus heading from Nairobi to Homa Bay veered off the road and rolled down a steep incline.
Preliminary investigations indicate the bus was overloaded and was speeding at the time of the accident.
LSK chairman Eric Mutua said apart from the traffic commandant, Attorney General Githu Muigai, Inspector of Police David Kimaiyo and the National Transport and Safety Authority, would be enjoined in the suit for allegedly failing to uphold constitutional principles of protecting lives and property of Kenyans.

ENFORCE TRAFFIC ACT
According to the letter, failure to enforce the Traffic Act and the law, had resulted in 1,731 lives being lost through road accidents since the beginning of the year.
Further, 12,000 people had suffered injuries and the country lost billions of shillings from the increasing carnage on the roads.
In his letter, Mr Mutua implicates traffic police officers in corruption, which is blamed for compromising safety on the roads.
“Take notice that unless we receive a credible and convincing work plan within the next 30 days we shall file proceedings in court to obtain a declaration that you be removed from office for willful negligence and incompetence,” said the LSK.
