Kethi does not have Masters - UoN

Tuesday, September 3, 2013 - 00:00 -- BY OLIVER MATHENGE AND MAXWELL MASAVA
THE University of Nairobi has written to the Narc party saying that lawyer Kethi Kilonzo is still a postgraduate student and does not have a Masters Degree.
In the letter dated August 12, UoN vice-chancellor George Magoha told Narc lawyers that Kethi should resit one of her exams in February last year but never did.
"Upon failing to satisfy the examiners and pursuant to her own request for remark in one paper GPR602 - Legal Research and.Methodology paper, the student was advised to resit the paper in question in the examination scheduled for February 2012. Ms Kilonzo is yet to resit the paper and as such continues to be a student," Magoha said in the letter.
Kethi is still qualified to practice law but does not yet have a Masters as stated in her records at the LSK.
Alphonce Mutinda & Co Advocates had asked the university whether she had a Masters on behalf of Narc.
Narc, part of the Jubilee Coalition, was contesting Kethi's nomination by Cord for the Makueni senate seat which fell vacant following the death of her father Mutula Kilonzo.
The Narc lawyers claimed that Kethi's degree had been recalled after being awarded irregularly. They also requested for all correspondence and internal memos relating to the matter.
"It is our contention, as well as a matter of Public Interest, that Ms. Kilonzo has a consistent trend of falsifying documents and obtaining documents, qualifications and/or clearances though untoward means," the lawyers argued.
According to documents seen by the Star, in December 2009 Kethi requested the university to remark one paper arguing that the grade awarded was inconsistent with her other papers.
"Kindly note that I believe and pray you so find that the fail I obtained in this paper, is inconsistent with my performance in the other eight courses in which l obtained 7As and 1B," Kethi wrote to the university.
A university memo dated December 12, 2009 approved the remarking.
However on October 12, 2011, the university wrote to Kethi saying that she had to re-sit the examination.
"The script has been remarked by two examiners and I hereby inform you that the joint examiners who remarked the script arrived at the conclusion that the script as graded by the internal examiner and the moderator stand and remain unchanged. Consequently, you are hereby informed that our records indicate you failed," the university told Kethi.
The Dean of Law advised Kethi to resit the paper with other LLM students in February 2012. Kethi did not do so.
Yesterday Kethi presented herself at the Directorate of Criminal Investigations at 2.30pm for formal pre-charge processing ahead of her appearance in Milimani court today.
Kethi is accused of stealing and forging an electoral document.
The CID took her fingerprints and drafting of the charge sheet against her.
Detectives were also expected to give her a police bond instead of detaining her ahead of today’s trial. The agreement for her presentation to the CID and bond was arrived at last week between State lawyers and her lawyer Julie Soweto.
Kethi was accompanied to the CID by lawyer James Orengo who arrived 30 minutes ahead of her and Daniel Maanzo.
Director of Public Prosecutions Keriako Tobiko last week approved charges against Kethi for allegedly faking the voter registration slip.
In early August the IEBC filed a complaint with the police that one of the documents she presented during the nomination process for the Makueni by-election was stolen and fraudulently filled in. Orengo has maintained that his client is innocent.
Kethi was disqualified from the race to succeed her late father Mutula Kilonzo. She was replaced by her brother Mutula Kilonzo Junior who won the July election by a land-slide.
