The Independent Electoral and Boundaries Commission is keen on appealing against a High Court judgment that quashed the election of Cornel Rasanga as the Siaya governor.
Lawyer Eric Gumbo who was representing the IEBC in the petition told the Nation on Friday that his appeal is on course.
“We are determined to appeal, we think a number of issues determined by the Hon Judge may be fit for a second opinion from a higher court,” Mr Gumbo said.
This is even as IEBC has set October 17 as the date when a by-election will be held at the county.
“As you perhaps know, (Mr) Rasanga has also preferred an appeal, we are yet to know on what grounds they intend to appeal but ours is firmly on course,” Mr Gumbo added.
Mr Gumbo filed a notice of appeal to the High Court in Kisumu on August 30.
“The IEBC and the Siaya Returning Officer, being dissatisfied with the judgment and orders of the honourable Justice Aggrey Muchelule delivered at Kisumu on August 23 intends to appeal to the Court of Appeal against the whole of the said ruling,” Mr Gumbo stated in the notice.
